Terms and Conditions


Service/s and Product/s ordered from a member of SMT Consultants are provided subject to the following Terms and Conditions. If a subsidiary's Terms differ from these, then it is the subsidiary Terms and Conditions which will apply:

  1. SMT reserves the right to change these Terms and Conditions at any reasonable time. Any changes are effective immediately upon posting to the company website. Your continued use of the website constitutes your agreement to such Terms and Conditions.
  2. Daily rates are revised annually and refer to a period not exceeding eight hours (including one hour for lunch), between 09:00 and 17:30. The minimum unit of chargeable time is half a day. A premium of 50% is charged for a unit of half a day. A premium of 50% applies to all work on a Saturday or Sunday.
  3. Health and Safety documentation payment/s is due upon issuing of drafy copy to the client to the client.
  4. The daily rate is inclusive of reasonable travel costs. Travel in excess of 100 miles per day may be charged at X cent per km plus VAT.
  5. Where it is agreed that overnight accommodation is necessary, this will be invoiced at cost.
  6. Other reasonable costs incurred in fulfilment of a contract may be passed on, by prior arrangement.
  7. SMT shall be entitled to levy cancellation/transfer fees, per consultancy/training day that has been cancelled or transferred, please see our Cancellation and Transfer Fee here.
  8. For public training course/s that have been booked on-line, phone or email the same cancellation terms will apply. Where a public course has been cancelled by SMT a full refund will apply. Any cancellations/transfers can be requested by contacting the SMT representative with whom you have made the booking. Alternatively, please visit our CUSTOMER FORMS page where you can fill out a Order Cancelation or Order Transfer Form.
  9. For webinar training course/s that have been booked on-line, phone or email the same cancellation terms will apply. Where a public course has been cancelled by SMT a full refund will apply. Any cancellations/transfers can be requested by contacting the SMT representative with whom you have made the booking. Alternatively, please our visit our CUSTOMER FORMS page where you can fill out a Order Cancelation or Order Transfer Form.
  10. Preparation time may be charged by prior arrangement. In the event of cancellation, the full cost of any agreed preparation time already utilised is chargeable in addition to any fee due under clause 5 above.
  11. Training fees are inclusive of course handout materials for a maximum of fifteen delegates per day, and the use/hire of SMT's training equipment (including training media where appropriate) unless specified to the contrary.
  12. The Customer undertakes to advise SMT of any foreseeable risks arising from the Customer's activities that may affect employees or agents of SMT during the performance of a contract.
  13. The Customer undertakes to provide such facilities, instructions and information as necessary to enable employees and agents of SMT to function without risk to safety or health, while on the Customer's premises.
  14. The Customers undertakes to make prior notification of any special personal protective equipment that SMT`s employees may reasonably require during the performance of a contract.
  15. Prior to commencement of Consultancy work a 50% Deposit on acceptance of Proposal/Quotation is required with the remaining 50% payable on completion of work where invoice is due for settlement within 7 days from date of issue of invoice unless more favourable terms are specifically agreed. SMT shall be entitled to contractual interest at a rate of 1% per week (compound) on outstanding amounts, after giving due notice. Invoices for training courses, are due for settlement before the date of the course unless more favourable terms are specifically agreed.
  16. Unless expressly stated to the contrary, all correspondence, reports and training notes etc. remains SMT's copyright. The Customer shall only be entitled to copy (in whatever media) such material for internal use as sanctioned by SMT.
  17. In connection with work activities, SMT may hold information relating to named individuals in various media. Such data will be used in accordance with the purposes for which SMT is registered under the Data Protection Act 1998 The Customer's name may be used for promotional purposes, but such reference will not include the name of individuals.
  18. Electronic communications are capable of alteration or corruption and therefore we do not accept any responsibility for changes to such communications after dispatch. We do not accept responsibility for any problems arising through the use of material provided electronically, and all risks relating to the continuing integrity of the content are borne by you. Reports sent or filed this way are sent on this basis. If you do not agree to accept this risk, you must notify us in writing that only written reports are acceptable.
  19. Except where there are statutory provisions to the contrary, SMT shall be entitled to destroy all material (including paper and electronic records) relating to work carried out: for a current Customer, after a period of two years; and in the case of a Customer who has commissioned no work within the previous twelve months, upon the expiry of that period.
  20. If an existing or former employee of SMT is directly or indirectly engaged by a Customer in any capacity within 12 months of carrying out a consultancy or training assignment for the Customer, the Customer shall be liable to pay an Engagement Fee equivalent to 20% of annual salary.
  21. Delegates will not be permitted to join any training courses after the indicated start time on this website. All fees will be charged and are not refundable for late arrivals and no shows.
